Terms and Conditions for Uplift and Evolve Coaching

1. Introduction

  • Purpose: These Terms and Conditions govern your use of Uplift and Evolve Coaching’s personal training services.

  • Acceptance: By enrolling in our services, you agree to abide by these terms. If you do not agree, please do not use our services.

 

2. Description of Services

  • Scope: Uplift and Evolve Coaching offers personal training sessions, group classes, and customized training programs.

  • Modifications: We reserve the right to modify or update the services as needed.

 

3. Payment Terms

  • Pricing: Fees for services, including packages and individual sessions, are detailed on our website and in any service agreement.

  • Payment Method: Payments must be made via Venmo, PayPal, cash or check.

  • Refund Policy: Fees are non-refundable unless stated otherwise. Any exceptions will be clearly communicated.

 

4. Booking, Cancellations, and Rescheduling

  • Appointments: All sessions must be booked in advance.

  • Cancellation Policy: A minimum of 12 hours notice is required to cancel or reschedule a session without penalty. Late cancellations or no-shows may incur a fee.

  • Rescheduling: We will make reasonable efforts to reschedule cancelled sessions, subject to availability.

 

5. Health and Safety

  • Medical Clearance: You confirm that you are physically able to participate in our training sessions. If you have any health concerns, you should consult your healthcare provider before participating.

  • Risk Acknowledgment: You understand that physical exercise carries inherent risks and agree to participate at your own risk.

 

6. Liability Waiver and Indemnification

  • Assumption of Risk: By using our services, you agree to release Uplift and Evolve Coaching and its trainers from any liability for injuries, accidents, or health issues arising from your participation.

  • Indemnification: You agree to indemnify and hold harmless Uplift and Evolve Coaching from any claims or damages related to your participation in the services.

 

7. Confidentiality and Privacy

  • Personal Data: We are committed to protecting your privacy. Your personal information will be used only for service provision and will not be shared with third parties without your consent.

  • Record Keeping: Training records and progress details are kept confidential and stored securely.

 

8. Modifications to Terms and Conditions

  • Updates: We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website and become effective upon posting.

  • Continued Use: Your continued use of our services after changes have been made constitutes acceptance of the new terms.

 

9. Governing Law and Dispute Resolution

  • Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.

  • Dispute Resolution: Any disputes arising out of or related to these terms shall be resolved through mediation/arbitration/court in Pennsylvania, unless otherwise mutually agreed upon in writing.

  • Integration: These Terms, along with any written agreements, represent the entire agreement between you and Uplift and Evolve Coaching regarding the services provided.
